Several months ago I wrote an article summarizing the status of bankruptcy law since institution of the BAPCPA "Reform" Legislation which became effective last October 7, 2005, (the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 - Public Law 109-8). That article summarized some of the most important changes including a description of the "means test," with its comparison to "median income". That article also describes provisions eroding the unlimited homestead of the Florida Constitution, including the creation of a ten year "look-back" to recapture value of monies invested in homesteads with fraudulent intent. -
