Federal Court Rules that Owner May Recover for Section 8 Rent Increase Denials ( November 2003 )
The plaintiff in <i>Cuyahoga Metropolitan Housing Authority v. United States</i>, 57 Fed. Cl. 751 (2003), successfully argued that its Section 8 Housing Assistance Payments ("HAP") contract required HUD to calculate rent increases and could not pass that burden on to the owner. The Court of Claims ruled that an owner may recover damages where HUD denied itsÃÂ Section 8 rent increase requests. -
